Chargers Set to File Grievance Against Foley

In a case very similar to the Jake Plummer – Broncos – Buccaneers episode, Jim Trotter ofFoley the San Diego Union-Tribune is reporting that the San Diego Chargers are seeking repayment a total of nearly $4 million in signing bonuses paid to former Charger Steve Foley that Foley earned while a member of the team.

Foley’s agent, David Levine, told the Union-Tribune that, We talked settlement and thought we had it resolved, but the paperwork was never drawn up and signed.  Evidently San Diego has had second thoughts on what we had agreed to.  We’re still hopeful there will be a resolution that we’re both pleased with.”  Chargers general manager A.J. Smith, in kind, had no comment in the matter.  However he stated that anything regarding Foley will come from either the Foley camp or Foley himself.

Levine also indicated that if the Chargers are successful in their grievance against Foley, any lost monies would be added to a lawsuit that Foley has filed against the City of Coronado and off-duty, not-in-uniform City of Coronado police officer Aaron Mansker.  For those who have lost track of the Foley incident, here is where we’re at right now:  Foley was shot three times by Mansker near Foley’s home, allegedly because Foley was “driving under the influence”.  In addition, Foley pled guilty to a drunken driving charge related to this incident, receiving five years unsupervised probation.

I would suspect that this matter will be resolved, but not without complications.  The lawsuit planned by Foley against the City of Coronado and Mansker may turn out to be a factor in the arbitrator’s final decision.  Let’s say for the sake of argument that the Chargers lose this grievance; the team could, in turn, file suit against the city of Coronado and Mansker in order to recoup their losses in their lost grievance hearing (which, by the way, is awaiting a date to be set).  So I’d say that this case isn’t as simple as the Plummer/Buccaneers/Broncos grievance matter.
